Should You Accept the Previous Buyer’s
Inspection Report?

Sometimes a house falls out of contract. Most buyers assume that it is related to a bad home inspection, but there are many reasons for a home to come back on the market that are unrelated to the condition of the home. During the contingency period, most buyers can cancel for almost any reason – or even no reason.

Of course, the listing agent and seller are motivated to get the home back under contract as quickly as possible and may offer the previous buyer’s home inspection report to the new buyer. Some may even ask that the new buyer remove their right to a home inspection, based on the one they offer.

If you have been offered the previous buyer’s inspection report, you’re probably wondering if you should accept it and remove that contingency. In a fast-moving seller’s market, it might be tempting, but before you accept the report, there are a few considerations:

• Before accepting the inspection, do your research. Who did the inspection? Is it a reputable, licensed home inspector? Check public review sites for comments and customer satisfaction. Check their license with the issuing board and see if they have had any violations or suspensions.
• Once you verify the company, give them a call. Make sure the inspection is transferable, and that they have performed a comprehensive inspection. Many companies offer both a comprehensive and a simpler, cheaper, visual inspection.
• Finally, read the report carefully. If there are issues discovered, ask for clarification and consider paying for the inspector to meet you at the home to discuss the report in person with you.

Accepting the home inspection might seem like a good idea – both to make your offer more appealing to the seller and to save a few dollars – but before you remove the home inspection contingency, do your homework. Make sure you understand the real condition of the property before you buy it.

Here’s What’s Happening

Winter decorations go up downtown

The iconic red bells and snowflakes hanging from lighted garland went up in downtown Whitefish Sunday morning.

Volunteers spent the morning hanging the winter decorations that have been a tradition in town since sometime in the 1950s. Each year volunteers spend weeks checking the roughly 10,000 bulbs in the decorations and preparing them to light up downtown.

The decorations include 24 snowflakes, 70 wreaths, four snowmen and 47 lighted garland strings.

The tradition began when John Austin, who was president of the Chamber of COmmerce, purchased the wire frames for 20 red bells for $1 a piece. He tasked John Thorson, who owned Flathead Upholstery, with putting new fabric on the wire frames.

Eventually the nonprofit Whitefish Shines took over the effort of maintaining and making sure the decorations decorate the town from late November through Presidents’ Day.

Hanging the lights has become a tradition of its own with volunteers of all ages showing up to assist in putting them up on the Sunday before Thanksgiving each year, no matter the weather. Read more…

Virus Playing Part in Booming Ranch Sales in U.S. West

Real estate brokers are experiencing high demand for ranches in Montana, Wyoming, Colorado, Idaho and Washington

BILLINGS — The coronavirus is one of the likely factors fueling a boom in large ranch sales in the U.S. West, real estate industry professionals said.

Real estate brokers are experiencing high demand for ranches in Montana, Wyoming, Colorado, Idaho and Washington, The Billings Gazette reports.

“It’s the craziest year I’ve ever seen,” said Jim Taylor, director and real estate partner for Hall and Hall, which has offices in Montana and other Western states.

Taylor said buying a ranch is not always a compelling investment because the rate of return can be low. But he is working with buyers who see fewer stable alternatives.

“People look at them as an investment even though the ranching business isn’t good,” Taylor said.

Andy Rahn of Montana Land Source, a website tracking land listings and sales in the state, said factors driving buyers to rural areas can include a “get me out of here kind of mentality” concerning the pandemic.

That mindset may be propelled by fear of social unrest as well as mask and social distancing mandates with which buyers disagree.

Some in the industry theorize buyers believe rural areas are safer from COVID-19, while others said people who already planned to buy property in the future were spurred to action by the pandemic. Read more…

Here is a quick and easy #pumpkinpierecipe that will leave you with enough time to relax before blowing your relatives’ taste buds away.

Ingredients:
✔️ 2 large eggs
✔️ 16 oz. (1 can) unsweetened pumpkin puree
✔️ 14 oz. (1 can) sweetened condensed milk
✔️ 1 tsp. pumpkin pie spice (cinnamon, nutmeg, ginger, cloves, and allspice)
✔️ 9 in. (1 pack) unbaked pie crust

Directions:
✔️ Preheat your oven to 425 F/220 C.
✔️ Mix together the eggs, unsweetened pumpkin puree, sweetened condensed milk, and pumpkin pie spice in a large bowl until thoroughly combined.
✔️ Spread the pie crust on a baking sheet.
✔️ Pour the pumpkin pie mixture over the crust.
✔️ Bake in the pie in the preheated oven for 15 minutes.
✔️ After 15 minutes, reduce oven heat to 350 F/175 C. Bake until the pie is set (about 35-40 min.)

What Home Buyers Are Looking for Now – Office Space

With major employers now stating that their employees will be working from home for the foreseeable future, many homebuyers have adjusted their list of desirables in their next home. Some not only need to plan for a home office space but also need to accommodate the homeschooling or distance learning needs of their children as well.

This is impacting the way homes are marketed and the type of features that have become important to buyers at all price points. Of course, homebuyers with larger budgets have the luxury of seeking homes with extra bedrooms or offices and dens already included. But many buyers need to find space in more creative ways.

The easiest way to add working space is within the bedrooms. This offers the ability to close a door for privacy. Larger bedrooms (both in master and secondary bedrooms) have been a top priority for homebuyers.

Another important feature is an open floorplan which features a Great Room design. For generations, kids have done their homework at the kitchen table, and a spacious kitchen/family room combo makes it easier for home learning without becoming cluttered. Another option for homebuyers is a separate formal dining room that could be converted to a workspace.

With all the changes in working and learning environments for both adults and kids, the home is even more important than ever. As needs change, homebuyers seek different features from their new dwellings.

Here’s What’s Happening

Changes made to highway zoning district

Whitefish has made a list of changes to the WB-2 zoning district along the highway, including removing personal services, which includes hair salons, from the uses allowed in the district.

City Council earlier this month approved the changes to make updates for what is a permitted use and what requires a conditional use permit in the zone.

Council, however, said personal services — like delivery, catering, event planning, recreational guiding, tattoo shops, personal training, and hair or nail salons or spas — shouldn’t be allowed in the zone, even as a conditional use.

Councilor Andy Feury said personal services should not be allowed in the WB-2 zone because the nature of those businesses means they often operate on a smaller scale and require being located inside a larger building with other such shops.

“There is a lot of places in the city where they can operate,” he said. “Previous discussions were that we didn’t want those businesses [in the WB-2]. They are a catalyst for strip malls.

Coronavirus impacts on the Montana land market

In such times of economic uncertainly people often gravitate towards tangible investments such as gold and land.  Given the health fears and social distancing caused by this crisis, land in rural western states like Montana have a particular appeal.  In addition to historically being a stable and lucrative investment, land in Montana provides a physical place where owners can take refuge from the rest of the world, whether that’s global pandemics or social unrest.  For years Montana land has been sought out for these reasons.  The shock and uncertainty of this crisis may well lead to increased demand for physical and economic refuge in the form of investment in rural land.

The ultimate impact of the coronavirus on the Montana land market will largely depend on the length of the crisis and the depth of its economic impact.  If the crisis is short-lived and the economic impact minor, we don’t expect the impact on the Montana land market to be substantial.

The slower moving land market may not have a chance to react before the crisis has largely passed.  Additionally, the drive towards more stable and tangible assets that crises like this create may offset negative impacts.  However, if the crisis is prolonged and if the economic impacts are severe, we will expect to see impacts on the Montana land market.  Montana Land Source has the most comprehensive data tracking of Montana land listings and sales, and we look forward to reporting on actual market impacts as the year progresses.  Stay tuned.

Whitefish selects firm for transportation plan study

The City of Whitefish has selected the engineering firm of KLJ to update its transportation plan.

The city is updating its transportation plan to project future improvements out to the year 2030. The current plan was created in 2009.

City Council on April 6 approved authorizing the City Manager to negotiate a contract with the engineering firm, which has an office in Kalispell, for the update. The city’s fiscal year 2020 budget includes $50,000 for the update.

Public Works Director Craig Workman said the firm is currently working with Kalispell to update its transportation plan.

“While they have not worked for the City of Whitefish on past project, we were extremely impressed with the research they completed to familiarize themselves with the city,” Workman said. “KLJ brings a diverse team with a deep background in transportation planning and we feel they will have a fresh perspective on the city’s transportation needs.”

The planning process will engage the public to identify and evaluate transportation conditions and alternate modes like biking, walking and public transit. Work on the plan will also evaluate the existing transportation conditions.

Whitefish takes proactive approach to pandemic

WHITEFISH PILOT // MARCH 19, 2020

Mayor John Muhlfeld on Thursday afternoon declared a state of emergency for the city related to the coronavirus.

Muhlfeld said the declaration allows the city to activate all emergency and disaster response plans within Whitefish and it also provides the ability for the city to recoup any funds related to emergency response plans related to the coronavirus.

“I want everyone in Whitefish to know that I have full faith and confidence in our emergency response plan and you should as well,” he said in a video released by the city.

The order also gives Whitefish the authority to control ingress and egress to all or part of the city, and reaffirming the ability to require employees that perform nonessential city services to work remotely.

“While this is definitely not a time to panic, it is a time to take bold action because what we do immediately will have long term implications,” Muhlfeld said.

Flathead County on Thursday issued an order by the county health officer closing bars, restaurants, casinos, athletic centers, indoor recreation facilities and theaters to the public. The order does not prevent restaurants from operating on a limited basis to provide take-out services, but they must close dining room facilities. The order goes into effect at 6 a.m. Friday, March 20.

Whitefish Market Heats up for 2020

January sales rose 16.5% in 2020 to 254 homes, compared to 218 in 2019 and 212 in 2018. January pending home sales ticked up 12% to 244 sales, showing a strong market for the new year.

As the Flathead Valley’s dining establishments pare back core services in response to emergency orders designed to slow the spread of coronavirus, local restaurants have begun dishing up prepared meals to food banks struggling to keep up with skyrocketing demands.

It’s a win-win arrangement for commercial kitchens trying to keep their pilot lights on and food banks whose inventories are dwindling rapidly amid the public health crisis.

To seed the partnership, the Whitefish Community Foundation awarded an initial $10,000 grant from its COVID-19 Emergency Response Fund to local restaurants willing to participate, including Café Kandahar and the Whitefish Lake Restaurant during the initial phase.

“We’ve all switched our operations to takeout only, but we have the pieces in place to do a lot more,” said Andy Blanton, executive chef and owner of Café Kandahar in Whitefish. “In the restaurant industry, we are masters of crisis. We are ready and willing to mobilize and get food to people in need, and this could help, especially if more restaurants get involved. It helps us a little with self-preservation and it helps the community at a time of need.”

New records set for January snowfall in northwest Montana

A steady stream of moisture form the Pacific yielded a significant amount of snowfall in the northwest river basins between December 30, 2019 and February 1, 2020. Many Mountain SNOTEL (snow telemetry) sites would report the highest, or second highest January snow totals on record. Although basins west of the divide would receive the most snowfall, the entire state benefited from the weather patterns during the month, with all river basins increasing their basin snowpack totals since January 1. All major river basins in the state are now near or above normal for snowpack for this date.

Visiting Glacier Park in Spring

Spring is a beautiful and quiet time to be in Glacier National Park, however park visitors must be more self sufficient for there are very few services open in the park in the early spring.

Although some services adjacent and inside the park are open year round, most of the concession services and services adjacent to the park reopen for the season in late May to early June. During shoulder seasons, lodging and other guest services are available in gateway communities, such as in Whitefish.

State economy saw growth last year

The state economy bounced back from stagnation last year with help from western counties and increased construction activity, among other factors, according to economists from the University of Montana visiting last week for the 2019 Economic Outlook Seminar.

State revenues in 2017 were weak due to a stagnant economy in 2016, said Patrick Barkey of the Bureau of Business and Economic Research (BBER), but 2018 revenues were stronger thanks in part to a surge in construction across the state but particularly in Flathead, Gallatin, and Missoula counties.

The three counties accounted for 75 percent of statewide construction earnings in 2017, with commercial and multifamily projects especially strong. Access to affordable housing remains an issue, as housing-price growth once again outpaced income growth.

Barkey said partial data indicates that 2018 saw continued growth, and that state revenue is off to a good start in 2019. However, this growth has largely missed the agricultural sector, which has faced low prices, drought, fire, and now the prospect of tariff-related disruptions in access to the market. The recently passed federal Farm Bill should help the agriculture industry, he said.

Revised plan for snow lot likely makes affordable housing project viable

Constructing roughly 24 homes on the city’s snow lot to provide affordable workforce housing would likely make the project financially feasible, according to an updated analysis of the proposed project.

The City of Whitefish has for many years targeted its snow lot, at the corner of Railway Street and Columbia Avenue, as a potential site for an affordable housing project.

A first analysis of the project designed with both single family homes and rental apartments completed in December, however, showed that the project would have a large funding gap to make up in order to make the project feasible. The city’s Whitefish Strategic Housing Plan Steering Committee deemed that option financially unfeasible and asked Homeword, a Missoula-based nonprofit taped to help design the project, to return with another option.

As the economy booms in the Flathead Valley, along with the rest of the nation, Montana continues to struggle filling job openings as 2020 arrives.

Job vacancies remain open in the valley while unemployment continues its low trend, contributing to the workforce shortage. Montana’s unemployment rate has hovered between 3 and 4 percent over the last year, with 3.4 percent in November 2019 and 3.7 percent in November 2018. Montana’s unemployment rate is slightly lower than the national average of 3.5 percent.

But a low unemployment rate means employers can’t find workers.

The Baker Avenue pedestrian underpass project

Whitefish appears to be keying in on an option for what the Baker Avenue pedestrian underpass might look like.

WGM Group last week presented City Council during its work session with preliminary cost estimates for a few choices related to the underpass that is planned to span under Baker near the O’Shaughnessy Center west connecting to the city’s path off of Railway Street to Depot Park.

Council seemed to favor an option that is estimated to cost about $1.63 million to construct the underpass. Under that option, a concrete structure would be used for then underpass with vertical interior walls 20 feet wide by 10 feet in height.

Glacier National Park Chalet Reopens for Business

A chalet in Glacier National Park is ready to begin taking reservations for the first time since a wildfire gutted the structure, officials said

The Sperry Chalet is expected to begin taking reservations online Monday at 8 a.m., KECI-TV reports.

The chalet dormitory fell prey to a wildfire in August 2017 and required a reconstruction of the facility, National Park Service officials said.

The park service authorized at least $12 million to rebuild the chalet, which is located at the end of a 6.7-mile (11-kilometer) hike in the park.

The chalet will be available for stays from July 18 to Sept. 13.

Sperry Chalet is a national historic landmark hotel, reachable only by trail.

Do the greatest quantity of single-family residence homes (sold for $150,000 to $600,000) sell with garages (and if so, attached or detached)? Across the county, and within all major cities within it, more homes sell with attached (AT) garages than those with detached (DE) garages or without a garage (NN means none). What have been the trends, these past 5 years?

The bars represent annual quantities sold by type; the lines of same color depict the median days they were on the market before going under final contract. For the county and Kalispell, homes with attached garages sell in triple the quantity of those with detached (other cities it’s about double). Which sell faster? Flathead Snowpack Above Normal

A dry spell in November and December decreased some of the autumn snowfall gains from September and October, but the early-season storms were still enough to provide a decent year-end snowpack in most mountains across Montana, even as many valley bottoms remained brown.

Early January snowfall is further boosting that base to above average in certain areas, with the Flathead River Basin’s snow-water equivalent registering 114 percent of normal as of Jan. 8 and most other basins in Central and Western Montana near or above normal as well, although a few are lagging considerably, especially the Lower Clark Fork and Madison, which sit at 86 and 85 percent of normal, respectively.

Snow-water equivalent, rather than snow depth, is the measurement used to gauge the amount of liquid water contained within snowpack, meaning the amount of water that will be released when the snowpack melts, which can play a key role in agriculture, hydropower production, water storage, aquatic ecosystem health and recreation such as boating and fishing, as well as flood and drought forecasting.

House Tax Bill HR-1 and the current state of 1031 Exchanges

Section 13303 of the Senate amendment revised Section 1031(a)(1) of the Code to provide that:

No gain or loss shall be recognized on the exchange of real property held for productive use in a trade or business or for investment if such real property is exchanged solely for real property of like kind which is to be held either for productive use in a trade or business or for investment.

What is like kind real property?

“Section 1031(a) requires a comparison of the exchanged properties to ascertain whether the nature and character of the transferred rights in and to the respective properties are substantially alike.”

“In making comparison, consideration must be given to the respective interests in the physical properties, the nature of the title conveyed, the rights of the parties, the duration nature or character of the properties as distinguished from their grade or quality. Koch v. CIR, 71TC 54,65 (1978)

Examples of like kind real properties include:

-A commercial building and an unimproved lot

-City real estate and a ranch or a farm

-Tenancy-in-common interest and a fee interest (the legal possession of both the surface and mineral rights for a property)

Ski and Snow Forecast is Optimistic for Winter of 2020

BY THE NATIONAL WEATHER SERVICE

Climate forecasters at the Climate Prediction Center predict a neutral El Nino to occur during the meteorological winter months of 2019-2020 (Dec-Jan-Feb) and possibly into spring. This absence of El Nino or La Nina could allow other global factors, such as the Madden-Julian Oscillation and Arctic Oscillation, to play a larger role in determining winter weather.

All that being said, the winter months of December-January-February should favor Above Normal Temperatures and Above Normal Precipitation for a good portion of Montana.
